Conditions of sale
Welcome to MyCoachingToolkit.com. We are part of an international network of websites and any visitors (the User) who wish to purchase and / or then download anything we offer for sale from our on-line shop, agree to comply with these Conditions of Sale and our full Terms and Conditions. They can be updated or amended at any time, so Users are advised to review them regularly.
Please read these Conditions of Sale carefully, before any Products are saved into the virtual shopping cart. By adding anything into the virtual shopping cart, Users fully accept both the Conditions of Sale and the full Terms and Conditions. Users also acknowledge the purpose for which the Site and the Products are intended.
1 – Legal information
MyCoachingToolkit.com is owned and operated by OutilsDuCoach (the Company), a private limited liability company (Société à responsabilité limitée – SARL) registered in the Paris Trade and Companies Register under the number B 483 579 884.

The website is available via the URL: https://mycoachingtoolkit.com and hosted on the servers of OVH whose head office is: 2 rue Kellermann, 59100 Roubaix.
2 – Introduction
The purpose of these Conditions of Sale, is to determine the rules for the use of the MyCoachingToolkit.com website (the Site) and its services, if any Users wish to purchase and / or then download anything we offer for sale. The Site offers a range of e-books, templates and kits, card games and training materials (the Products) for use by the coaching community.
The Products are only available via download from our on-line shop once full payment has been received and are designed to be used by an individual coach (single user license) in one-on-one or group coaching sessions, workshops or seminars. The Products should only be used by somebody who is appropriately qualified or informed and are not intended as a source of advice.
The Company exclusively owns the Products and by accessing the Site, the User fully accepts the full Terms and Conditions and acknowledges the purpose for which the Site and the Products are intended. If any of the Products are used for an unauthorized purpose, the single user license is automatically terminated.
The Company does not accept liability for the subsequent use of the Products and if the Company is found in law to have any liability, this liability shall be limited to the cost of the Product purchased from the Site.
3 – Definitions
Within both these Conditions of Sale and the full Terms and Conditions, words or expressions starting with a capital letter will have the following meaning:

Cookie – A Cookie is a small piece of data sent from a website and stored on the user’s computer to help the website remember information.
Files – Anything that an be downloaded or saved from the Site
Information – Any content available on the site
Products – The range of e-books, templates and kits, card games and training materials available via download once payment has been received. They are designed to be used by an individual (single user license) the coaching community in one-on-one or group coaching sessions, workshops or seminars. They are not intended as a source of advice.

User – Any individual who access the Site, regardless of where they are and how they connect to the Site.
4 – Customer Service
We are here to help during normal office hours: Monday to Friday from 9.30am to 5.00pm.

We aim to respond to all emails within 24 hours during the week or on the next working day if received at the weekend or on public holidays.
5 – Shop
The Site is available at no charge, however we do also offer a range of Products for use by the coaching community via our on-line shop. You can add items to your virtual shopping cart and then either register and log-in to purchase the Products selected or make your payment as a guest.
5.1 – Downloading
The Products you purchase from the Site will be available to download via the order confirmation page once the full payment has been processed. A confirmation will then be displayed and acknowledgment e-mail sent.
The Products are designed to be used by an individual coach (single user license) in one-on-one or group coaching sessions, workshops or seminars. The Products should only be used by somebody who is appropriately qualified or informed and are not intended as a source of advice.
Once purchased and downloaded, the Products can be rebranded, printed or e-mailed as part of the coaching process, however they cannot be re-sold, given away or made available for free on-line.
Please note:
• Reselling the Products (directly or indirectly, in whole or in part) is strictly prohibited.
• Giving away the Products or making them available online is strictly prohibited.
5.1 – Payment methods
Payments can be made in two ways:
• Credit card payments – If you wish to pay with a credit card, you will need to select to pay via one of our partners (Stripe or PayPal). You do not need a PayPal account to pay with your credit card if you select PayPal as the secure payment partner.
• PayPal payments – If you do want to use your PayPal account, you will be asked to sign in and access your account as part of the secure on-line payment process.
Please note: Financial information is not collected or held on the Site.
5.2 – Cancellations
Under Article L.121-20-2 of the French Consumer Code, the right of withdrawal cannot be exercised when the supply of services has started, with the consumer’s agreement, before the seven-day withdrawal period has expired.
5.4 – Tax
Taxes are not included in the price displayed and are the sole responsibility of the User.
6 – Personal Data
The Company follows the General Data Protection Regulation (GDPR) guidance to control, process, handle and protect personal information collected via the following forms:
• Newsletter sign up
• Setting up a user account
• Downloads and purchases from our on-line shop
By completing and submitting these forms, the User agrees to the Site using the information exclusively for the reason it was provided.
All personal data is strictly confidential and allows the Site to process orders via our on-line shop. It is never shared with third parties, but is used to send a regular e-newsletter. To opt out of the e-newsletter at any time, please click on the ‘unsubscribe’ link at the bottom of the e-mail.
7 – User Account
The User may wish to set up a password protected account on the Site and complete the profile information. This enables the User to add comments to blog posts, save personal details and gives easy access to any Products they purchase from the on-line shop.
A User account is set up and managed via the ‘head icon’ at the top right of the homepage. This is an automated process and no financial information is collected or held on the Site.
8 – Passwords
The User account password can be updated at any time and it remains the responsibility of the User to select and keep safe the password used to log into the Site.
If the User feels their password has been compromised in any way, they must notify the Site immediately via the contact form, so a new password can be issued.
9 Cookies
A Cookie is a small piece of data sent from a website and stored on the User’s computer to help websites remember information on the User and their browsing activity. This includes items added to the virtual shopping cart, information entered into a form and if the User is logged in or not, and what User account they are logged in with.
Cookies help the Site function correctly, however if the User sets up their browser to block or refuse them, some of our website services may not be fully accessible or work correctly. The Site does not store Cookies once the current session has ended and the user can manage, deactivate or delete Cookies at any time, by using the options within their internet browser.
